The use of the copyright notice and the registration of a work are referred to as formalities and were formerly requirements for copyright protection. The discussion of the copyright formalities in BitLaw is divided into the following sections. For most of modern copyright law’s existence, a work of expression received copyright protection only if the author complied with several formalities, such as registering the work with a government agency and placing a copyright notice on each copy of the work (the ubiquitous C-in-a-circle). These formalities served two functions.
For works published between and March 1, , it depends on whether the certain statutory formalities were observed, such as providing a notice of copyright or following proper procedure for renewing the copyright. Typically, statutory copyright protection is awarded to an original work of authorship fixed in a tangible medium of expression. Work is defined to include any of the following: literary, musical, dramatic, pantomimes and choreographic, pictorial graphic and sculptural, motion pictures and audiovisual and sound recordings and architectural.
All terms of copyright run through the end of the calendar year in which they would otherwise expire, so a work enters the public domain on the first of the year following the expiration of its copyright term. For example, a book published on 15 March will enter the public domain on 1 January , not 16 March (+95=). 4. Protection is given to works first published in India, in respect of all countries that are member states to treaties and conventions to which India is a member. Thus, without formally applying for protection, copyright protection is available to works first published in India, across several countries.

At present, copyright is ‘automatic’. Old-style Canadian formalities will then be constructive as means to inhibit overprotection and enhance economic efficiency of information markets. The fact that the Canadian legislature crafted such an elegant solution to prevent socially undesirable impacts of copyright protection suggests that legal futures can find their fortune in legal pasts.
Copyright formalities are legal (generally statutory) requirements needed to obtain a copyright in a particular jurisdiction. Common copyright formalities include copyright registration, copyright renewal, copyright notice, and copyright deposit.
Why Worry About Statutory Formalities. Two Reasons: • Private Lawsuits and • Government Audits. Every state has revised statutes that describe exactly what a government created business entity must do to maintain a “Corporate Veil”.
A “Corporate Veil” is a layer of protection that separates individuals involved in a business from the business entity. A literary work is a work that explains, describes, or narrates a particular subject, theme, or idea through the use of narrative, descriptive, or explanatory text, rather than dialog or dramatic action.

There is no such thing as an "international copyright" that will automatically protect an author's works in countries around the world. Instead, copyright protection is "territorial" in nature, which means that copyright protection depends on the national laws where protection is sought.

Article 5(2) of the Berne Convention explicitly states that the enjoyment and the exercise of copyright shall not be subject to any formality. The granting of copyright on a work is automatic upon creation of that work.
Some countries did -or still do- require some formalities. Therefore, a country that is a member of the Berne Union must afford copyright protection to foreign nationals without a requirement of any formalities (like use of a copyright notice or a registration requirement).
Foreign nationals must be afforded the same rights and treatment that a domestic copyright holder would receive. Since March 1,the United States has been a member of an international copyright treaty named the Berne Convention (formally called the "International Union for the Protection of Literary and Artistic Works").
This treaty was established on September 8, in, of course, Berne, Switzerland. The World Intellectual Property Organization, located in Geneva, Switzerland, is charged with.

Once the work was published, state copyright protection was ousted, by virtue both of state law and of the federal statute. If such publication was accompanied by compliance with the federal statutory formalities-in particular the placement of proper notice on all copies distributed to the public-federal copyright protection was afforded.
Inthe Ontario government, under pressure from a government department that used EDI, repealed the two most problematic occurrences of Statutory formalities-- the Sale of Goods Act's signed writing requirement for sales over $40, and the Statute of Frauds' application to contracts not to .U.S., made punctilious compliance with multiple statutory formalities a condition of both the existence and the enforcement of copyright.
The role of formalities as barriers to protection arose primarily when authors or publishers sought exclusive rights for territories outside the work’s country of origin.Under the principle of automatic protection, a work will be granted protection even if it fails to satisfy formalities, such as registration or legal deposit, under the national law of a member country.
The Berne Convention covers a wide range of works including books, pamphlets and other writings, lectures, dramatic works and illustrations.
